Notification of Proposed Land Use Activity
Notifying the Land Trust of a Proposed Change on Your Easement-Protected Property
If you’re the owner of a property that's been protected with a Jefferson Land Trust conservation easement and are planning any changes in the use or management of your easement-protected property, please fill out the form below as the first step in notifying Jefferson Land Trust of these proposed changes.
Notice and Consent Requirements
Each conservation easement is different, and some provisions of conservation easements require landowners to give notice to the Land Trust prior to undertaking certain permitted uses and activities. Some activities may also require advance written consent of the Land Trust.
The purpose of requiring landowners to notify and seek the consent of the Land Trust prior to undertaking these permitted uses and activities is to afford us an adequate opportunity to ensure that the use or activity in question is designed and carried out in a manner consistent with the terms and purpose of the easement.
For activities that don’t require notice or consent, you're still welcome to check in and confirm that any planned change on the land is consistent with the terms and purpose of your conservation easement.
Notice Period
In cases where notice is required by your easement and no timeline for notice is specified, you’ll need to provide notice at least 30 days prior to the desired start date of your proposed activity or project.
Use the form below to notify the Land Trust of the proposed change and we’ll follow up with you regarding any questions and supplemental information or documentation we might require.
Content and Purpose of the Notice
In your notice, please describe the nature, scope, design, location, timetable, and any other material aspect of the proposed use or activity in sufficient detail to allow the Land Trust to make an informed judgment as to its consistency with the terms and purpose of the easement.
